EB-5 Visa Attorney

If you are a foreign national who wishes to come and live in the U.S. permanently by investing in a business, you will first need to obtain an EB-5 visa. To qualify under this visa category, you must be planning to invest at least $500,00 in a commercial enterprise located in a Targeted Employment Area (TEA) or $1,000,000 in a non-TEA business that will create at least ten or more jobs for U.S. citizens or authorized foreign workers within two years. In case you are wondering, a TEA is a rural area or an area characterized by high unemployment that would benefit from the economic growth brought about by your foreign investment. Moreover, proving the source and path of funds is an extremely important part of the EB-5 process. Once your EB-5 visa application is approved, you will be granted conditional lawful permanent resident status (Green Card) which will be valid for two years. Prior to the expiration of your conditional Green Card, you have to file a new application and supporting documents to prove that your funds were invested in the commercial enterprise and ten jobs were created in order to obtain a ten-year Green Card.

New Changes to the EB-5 Visa

On November 21, 2019, the following NEW changes to the EB-5 Visa program will go into effect:

  • The minimum investment amount will be raised to $900,000 and $1,800,000 for TEA and non-TEA commercial enterprises, respectively, and they will be automatically adjusted for inflation every five years.
  • States will no longer be allowed to designate Targeted Employment Areas based on the census tract; the Department of Homeland Security will instead be slated to undertake this responsibility.
  • Derivative family members who are lawful permanent residents will have to independently file if they want to remove conditions on their permanent residence.
  • If you have a previously approved petition, you will be allowed to keep your priority date when you reapply for an EB-5 visa.
